WELLNESS MAGAZINE “2ND ANNUAL COUNTDOWN TO SUMMER WELLNESS SERIES 2009 CONTEST”

OFFICIAL RULES

1.  ELIGIBILITY: NO PURCHASE NECESSARY. Only residents of Long Island, NY (Queens, Suffolk and Nassau counties) are eligible to enter Newsday’s Wellness “2ND Annual Countdown to Summer Wellness Series 2009 Contest” (hereinafter the "Contest"). Entrants must be at least 40 years old. Employees of Newsday, Island Publications, Inc., Hoy, amNY, and their advertising or promotion agencies, parent companies, service providers, agents, officers, subsidiaries or affiliates, or any other persons or entities directly associated with the Contest (hereinafter "Contest Entities") and members of the immediate families and/or persons living in the same household as such persons, are ineligible to enter the Contest.

2. HOW TO ENTER: Log onto www.newsdaywellness.com between October 8, 2008 and Dec. 1, 2008 and look for “Countdown to Summer Wellness Series 2009 Contest” logo. Click on the logo for details on how to enter for your chance to participate. Contestants must submit a recent full-length photo and a 50-word statement on their desire to improve their physical and nutritional well-being (engage in a regular exercise program and improve their dietary habits). Entries must be received by Dec. 1, 2008.  LIMIT OF ONE ENTRY PER PERSON. ENTRIES THAT FAIL TO MEET WORD COUNT LIMIT WILL BE DISQUALIFIED.   Entries should be mailed to Wellness Editor, Countdown to Summer Wellness Series 2009 Contest, 235 Pinelawn Road, Melville, NY 11747. By entering, Contestants grant the non-exclusive right to the Contest Entities to post their essays and/or submitted photos on websites and to publish them in future publications. The Contest Entities are not responsible for lost, incomplete, damaged, illegible, late, postage due or misdirected entries for any reason. By entering, Contestants release Contest Entities from any and all liability, claims or actions of any kind whatsoever for damages or losses to persons that  may be sustained in connection with the Contest entry, ownership or use of the prize.

3. PRIZE:  Two (2) winners will be selected by the judges to participate in the Wellness Countdown to Summer Wellness 2009 Series (the “Wellness Series”). The Wellness Advisory Board (a fitness trainer, a life coach, and a nutritionist) will create lifestyle  improvement program for each winner based on his or her written goals for healthy lifestyle changes.  Approximate retail value of each prize is $0. The winners must commit to participating from the start to the finish of the Wellness Series, which is Jan. 1, 2008 to June 1, 2008. Winners must agree to have their photos appear in three issues of Wellness magazine and posted on the Wellness website, and must commit to following the recommendations of the Wellness Advisory Board.

4. JUDGING AND NOTIFICATION: The winners will be chosen by a panel of judges consisting of the Wellness staff and the Island Publishing Group Publisher. The winners will be selected based on their sincerity, originality, and desire to make a change to a healthy lifestyle. The winners will be notified by phone by Dec. 5, 2008. The Contest  judges' decision is final and binding in all respects.  If potential winners cannot be reached by the daytime phone number provided on the entry, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, or if the winner is unable to use the prize, an alternate winner will be selected by Contest judges based on the same criteria. All entries become Sponsor's property and will not be returned.

5. GENERAL CONDITIONS: All Federal, state and local laws and regulations are applicable. All taxes (including, but not limited to, income taxes) are the sole responsibility of winners. Prize winner must execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (Affidavit/Release) and to supply to Sponsor a valid doctor’s certification that the winner is in good health and that there are no medical contraindications against the winner engaging in the Wellness Series.  Sponsor may provide Affidavit/Release to winners on arrival to pick up their tickets, or via fax. Non-compliance may result in disqualification and an alternate winner may be chosen. Return of prize, prize notification, or Affidavit/Release as undeliverable will result in disqualification and an alternate winner may be selected. Entry and/or acceptance of prize constitutes permission for the Sponsor and its licensees and affiliates to use the winner's name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law. All entrants agree to comply with these Official Rules. Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these Official Rules, will be disqualified. Sponsor at its sole discretion, reserves the right to cancel or modify the Contest, without liability. Void where prohibited, restricted or taxed by law. The Contest will be governed by the law of New York, excluding choice of law provisions.

6. DISCLAIMERS: Entrants agree that the Contest Entities shall not be liable for losses or injuries of any kind resulting from acceptance/possession and/or use/misuse of the prize, participation in Contest, or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, computer dating mechanism, computer equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. Entrants also agree that the Contest Entities are not responsible or liable for any injury or damage to an entrant or third person's computer related to or resulting from Contest and its prize. The Contest Entities are not liable for damage to a user's computer system in any way due to an entrant's participation in the Contest or downloading any information in connection with the Contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction.
